• Ownership and Operation: Naseem Bazaar (“Website”, “Platform”, “we”, “our”, or “us”) is owned and operated by Smart Information Technologies (Pvt) Limited. All services, transactions, communications, and policies provided through Naseem Bazaar are managed by Smart Information Technologies (Pvt) Limited unless otherwise stated.

1. Introduction

These Customer Terms & Conditions (“Terms”) govern your access to and use of the Naseem Bazaar website, mobile applications, and related services (collectively, the “Platform”).

By accessing, registering, or placing an order on the Platform, you agree to be legally bound by these Terms, along with our related policies, including but not limited to:

• Shipping Policy
• Delivery, Return & Exchange Policy
• Refund Policy
• Privacy Policy

2. Marketplace Role (Important Legal Position)

Naseem Bazaar operates strictly as an online intermediary platform that connects customers with independent third-party vendors (“Vendors”).

• Naseem Bazaar does not own, manufacture, stock, or sell any products listed on the Platform.
• All products are offered and sold directly by Vendors.
• Any purchase you make forms a direct contractual relationship between you and the Vendor, not with Naseem Bazaar.
• Naseem Bazaar’s role is limited to providing technology, payment facilitation, and customer support infrastructure.

3. Payment Facilitation Disclaimer

All payments made on the Platform are processed through third-party payment service providers.

By placing an order, you acknowledge that:

• Naseem Bazaar acts only as a payment collection and settlement facilitator on behalf of Vendors
• The obligation to fulfill the order lies solely with the Vendor
• Payment to Naseem Bazaar is considered payment to the Vendor

4. Eligibility & Account Responsibilities

• You must be at least 18 years old to use the Platform
• You agree to provide accurate and complete information
• You are responsible for maintaining the confidentiality of your account credentials
• Any activity conducted through your account is your responsibility

5. Product Listings & Accuracy

All product descriptions, images, specifications, pricing, and availability are provided by Vendors.

Naseem Bazaar:

• Does not guarantee that listings are error-free, complete, or accurate
• Is not responsible for product quality, legality, safety, or authenticity

6. Orders & Acceptance

• Placing an order constitutes a binding offer to purchase from the Vendor
• Vendors reserve the right to accept or reject orders due to availability, pricing errors, or other reasons
• Orders are confirmed only after payment authorization and Vendor acceptance

7. Shipping & Delivery

• Shipping timelines, methods, and charges are determined solely by the Vendor
• Estimated delivery times are not guaranteed
• Naseem Bazaar is not responsible for delays, including those caused by logistics providers or customs

International Orders

Customers are solely responsible for:

• customs duties
• import taxes
• clearance charges

Failure to pay such charges may result in return or cancellation with applicable deductions.

8. Returns, Refunds & Dispute Resolution

Return Requests

• Customers may request a return within 7 days of delivery, subject to applicable policies
• Return requests are reviewed and decided by the Vendor

Vendor Response Timeline

• Vendors are required to respond within 7 days
• If a Vendor fails to respond, Naseem Bazaar reserves the right (but is not obligated) to intervene and make a final decision

Refund Method (Strict Policy)

• All refunds are issued only as platform store credits (wallet balance)
• No cash refunds, bank transfers, or reversals will be provided under any circumstances

Deductions

Refunds may be subject to deductions, including but not limited to:

• shipping costs
• payment processing fees
• applicable Vendor charges

9. Store Credit (Wallet) Terms

• Store credits are non-transferable and non-withdrawable
• Store credits cannot be exchanged for cash
• Naseem Bazaar reserves the right to define validity periods and expiration terms at the time of issuance

10. Customer Conduct

You agree not to:

• Engage in fraudulent or abusive activities
• Misuse the Platform or exploit system vulnerabilities
• Attempt to bypass the Platform to transact directly with Vendors
• Submit false claims or disputes

11. Reviews & User Content

By submitting reviews or content:

• You grant Naseem Bazaar a royalty-free, perpetual license to use, display, and distribute such content
• Naseem Bazaar reserves the right to remove content at its discretion

12. Intellectual Property

All Platform content, including text, design, logos, and software, is the property of Naseem Bazaar or its licensors and is protected under applicable laws.

13. Limitation of Liability

To the maximum extent permitted by law:

Naseem Bazaar shall not be liable for:

• Vendor actions, omissions, or negligence
• product defects or misrepresentations
• shipping delays or delivery failures
• indirect, incidental, or consequential damages

Naseem Bazaar’s total liability, if any, shall not exceed the amount paid for the relevant order.

14. Indemnification

You agree to indemnify and hold harmless Naseem Bazaar, its directors, officers, and employees from any claims, damages, or losses arising from:

• your breach of these Terms
• your misuse of the Platform
• disputes with Vendors

15. Force Majeure

Naseem Bazaar shall not be liable for delays or failures caused by events beyond reasonable control, including but not limited to natural disasters, pandemics, government actions, or logistical disruptions.

16. Suspension & Termination

Naseem Bazaar reserves the right to suspend or terminate your account if:

• you violate these Terms
• you engage in fraudulent or harmful conduct

17. Governing Law

These Terms shall be governed by the laws of the Islamic Republic of Pakistan, without prejudice to mandatory consumer protection laws applicable in your jurisdiction.

18. Amendments

Naseem Bazaar reserves the right to update these Terms at any time. Continued use of the Platform constitutes acceptance of updated Terms.
